Welcome to Superior Motor Club. These Terms and Conditions ("Terms") govern your use of our website and the rental of vehicles from Superior Motor Club ("Company," "we," "us," or "our"). By accessing our website or booking a vehicle, you agree to be bound by these Terms in their entirety. If you do not agree with any provision herein, you must refrain from using our services.

1. Rental Eligibility

To rent a vehicle from Superior Motor Club, you must meet the following requirements:

• Minimum Age: You must be at least 21 years of age. Renters between 21 and 24 years old may be subject to a young driver surcharge and additional insurance requirements at our discretion.
• Valid Driver's License: You must hold a valid, unrestricted driver's license issued in the United States or a recognized international driver's license. Learner's permits, temporary licenses, and restricted licenses are not accepted.
• Insurance Coverage: You must provide proof of valid automobile insurance that covers exotic and luxury vehicles, including comprehensive and collision coverage. If your personal policy does not extend to rental vehicles of this class, you must purchase supplemental coverage through us or a third-party provider prior to rental.
• Clean Driving Record: We reserve the right to decline a rental to any individual with a history of DUI/DWI convictions, reckless driving charges, license suspensions, or multiple at-fault accidents within the past five years.
• Credit Card: A valid credit card in the renter's name must be provided for the security deposit authorization. Debit cards, prepaid cards, and third-party credit cards are not accepted for deposit purposes.

2. Booking and Reservations

All reservations are subject to vehicle availability. A reservation is not confirmed until you receive written confirmation from Superior Motor Club via email. We reserve the right to substitute a vehicle of equal or greater value if the originally reserved vehicle becomes unavailable due to maintenance, prior rental damage, or unforeseen circumstances.

A non-refundable booking fee may be required at the time of reservation for certain high-demand vehicles or peak-season dates. The booking fee will be applied toward the total rental cost.

3. Cancellation Policy

We understand that plans change. Our cancellation policy is as follows:

• More than 48 hours before pickup: Full refund of any prepaid amounts, excluding any non-refundable booking fees.
• 24 to 48 hours before pickup: A cancellation fee equal to 50% of the first day's rental rate will be charged.
• Less than 24 hours before pickup: The full first day's rental rate will be charged as a cancellation fee.
• No-show: If you fail to pick up the vehicle or be present for delivery at the scheduled time without prior notification, you will be charged the full rental amount for the first day and your reservation may be canceled.

All cancellation requests must be submitted in writing via email to booking@superiormotorclub.com.

4. Payment Terms

All payments are processed securely through Stripe. At the time of booking, an authorization hold equal to the estimated rental total plus a security deposit will be placed on your credit card. The actual charge is captured at the time of vehicle pickup after a final walk-around inspection.

The security deposit amount varies by vehicle and ranges from $2,500 to $15,000. The deposit hold is released within 5 to 10 business days following the return of the vehicle in its original condition, subject to inspection. Additional charges for fuel, mileage overages, tolls, traffic violations, cleaning, or damage may be deducted from the deposit before release.

We accept Visa, Mastercard, and American Express. All prices listed on our website are in US Dollars and do not include applicable taxes and fees unless otherwise stated.

5. Vehicle Use Restrictions

When renting a vehicle from Superior Motor Club, you agree to the following use restrictions:

• No Racing or Track Use: Vehicles may not be used for racing, speed testing, track events, rallies, or any form of competitive driving.
• No Off-Road Use: Vehicles must remain on paved, publicly maintained roads at all times. Off-road driving, including gravel roads, dirt paths, and construction zones, is strictly prohibited.
• No Subletting: You may not sublease, sublend, or transfer the vehicle to any third party, including ride-sharing or car-sharing platforms.
• Authorized Drivers Only: Only the individual(s) listed on the rental agreement may operate the vehicle. Unauthorized drivers void all insurance coverage and make you solely liable for any damages or incidents.
• No Smoking: Smoking of any kind, including cigarettes, cigars, vapes, and other tobacco or cannabis products, is strictly prohibited inside all vehicles. A minimum cleaning fee of $500 will be assessed for violations.
• No Illegal Activities: Vehicles may not be used for any unlawful purpose, including but not limited to transporting illegal substances, evading law enforcement, or exceeding posted speed limits.
• Geographic Restrictions: Vehicles must remain within the continental United States unless prior written authorization is obtained. Vehicles may not be taken across international borders.

6. Mileage Policy

Each vehicle rental includes a daily mileage allowance as specified on the vehicle listing page and the rental agreement. The standard daily allowance ranges from 100 to 200 miles per day depending on the vehicle. Miles in excess of the daily allowance are charged at the per-mile overage rate specified in your rental agreement, typically ranging from $1.50 to $5.00 per mile depending on the vehicle class.

Custom mileage packages are available for extended trips and may be arranged prior to rental. Extended rentals may include enhanced mileage allowances. Contact our team to discuss options.

7. Damage and Liability

You are responsible for the vehicle from the moment of pickup until the moment of return. Any damage to the vehicle, regardless of fault, is the renter's responsibility. This includes but is not limited to:

• Body damage, scratches, dents, and paint damage
• Windshield chips, cracks, or replacement
• Tire and wheel damage, including curbing of rims
• Interior damage, stains, tears, and burns
• Mechanical damage resulting from misuse, neglect, or improper operation
• Towing costs resulting from misuse or negligence

A pre-rental and post-rental vehicle inspection will be conducted in your presence. Both parties will acknowledge the condition of the vehicle via photographic documentation. Any discrepancies identified during the post-rental inspection will be documented, and repair costs will be charged to the renter's credit card on file.

In the event of an accident, you must immediately contact local law enforcement and Superior Motor Club. Failure to report an accident is a violation of these Terms and may result in additional liability. You are responsible for all applicable deductibles under your insurance policy.

8. Insurance Requirements

All renters must maintain active automobile insurance for the duration of the rental period. Your insurance must include:

• Comprehensive coverage with a minimum limit adequate to cover the vehicle's value
• Collision coverage with a maximum deductible of $2,500
• Liability coverage meeting or exceeding New York State minimums ($25,000/$50,000/$10,000)

We strongly recommend increasing your coverage limits to at least $100,000/$300,000 for exotic vehicle rentals. Supplemental Liability Insurance (SLI) and Collision Damage Waiver (CDW) options are available for purchase at the time of rental.

9. Vehicle Delivery and Return

Superior Motor Club offers complimentary vehicle delivery and pickup within the New York City metropolitan area, including Manhattan, Brooklyn, Queens, the Bronx, Long Island, Westchester, the Hamptons, and Northern New Jersey. Deliveries outside the standard service area are available for an additional fee.

Vehicles must be returned at the agreed-upon time and location with the same fuel level as at pickup. Late returns will incur an additional hourly charge at 1/8th of the daily rate per hour, with a maximum of one additional full day's rate. Returns more than 4 hours late without prior arrangement will be charged a full additional day.

The vehicle must be returned in the same condition as received, less normal wear and tear. Excessive dirt, debris, pet hair, or odors will result in a cleaning fee ranging from $150 to $500 depending on the severity.

10. Traffic Violations and Tolls

You are responsible for all traffic citations, parking tickets, red-light camera violations, and toll charges incurred during the rental period. An administrative fee of $50 per violation may be assessed in addition to the fine amount. Unpaid violations will be charged to the credit card on file along with the administrative fee.

11. Dispute Resolution

Any disputes arising from these Terms or your rental agreement shall first be addressed through good-faith negotiation between the parties. If a resolution cannot be reached within 30 days, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of New York, County of New York. The arbitrator's decision shall be final and binding.

You waive any right to participate in a class action lawsuit or class arbitration against Superior Motor Club. Each claim must be brought individually.

12. Limitation of Liability

To the fullest extent permitted by law, Superior Motor Club shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of our services, including but not limited to lost profits, lost data, personal injury, or property damage, except where caused by our gross negligence or willful misconduct.

Our total liability for any claim related to a rental shall not exceed the total rental charges paid for the applicable rental period.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. You consent to the exclusive jurisdiction of the state and federal courts located in New York County, New York, for any legal proceedings arising out of these Terms.

14. Modifications

Superior Motor Club reserves the right to modify these Terms at any time. Changes will be posted on our website with an updated "Last Updated" date. Your continued use of our services following any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
